Terms of Service

1. The service

Cortex builds a private model of how you think and communicate (your brain) from material you choose to provide, and lets you, and people you authorize, query it through the web app, REST, MCP and voice. Cortex is software delivered over the internet. Answers are generated by AI models and can be wrong; do not rely on a clone for medical, legal, financial or safety decisions.

2. Accounts and eligibility

You must be at least 18 years old to create an account. Give accurate information, keep your password and API keys secret, and tell us promptly at aashwin@makecortex.com if you think your account has been compromised. You are responsible for activity under your account, including activity through your API keys.

3. Your content and your clone

You keep ownership of everything you upload, record or connect, and of your brain. You give us a limited licence to host, process and transmit that content only to run Cortex for you and for the people you authorize, including sending it to the AI and infrastructure providers listed in our Privacy Policy. We do not use your content to train models.

You confirm you have the right to upload what you upload. Your clone is private by default. If you make it public, anyone with the link can query it, and you are responsible for what you have allowed it to say.

4. Voice cloning and consent

You may only create a voice clone or a brain of yourself. A voice clone is built from recordings of your own voice, and the recording script asks you to state that you consent to the clone. You must not:

• clone another person’s voice, or build a brain that presents itself as another person, without that person’s explicit, documented consent;
• use a clone to impersonate anyone, to deceive someone into believing they are speaking with a live human when that matters to them, or to commit fraud;
• use a voice clone to pass voice-based identity or authentication checks, such as bank or telephone verification;
• create sexual content, harassment, threats or political disinformation with a clone.

We may remove a voice clone or a brain, and suspend the account, if we reasonably believe it was created without the consent of the person it represents.

5. Acceptable use

Do not use Cortex to:

• break the law or infringe anyone’s rights, including privacy and intellectual property;
• upload other people’s personal data that you have no right to share;
• probe, scan or test our systems without permission (good-faith security research is welcome under our disclosure policy);
• get around rate limits, plan limits, bot checks or access controls, or access another user’s data;
• resell Cortex, or provide it as a service to third parties, without our written agreement;
• distribute malware or spam, or any content that sexualizes minors.

6. API and MCP access

API keys are tied to your account and you can revoke them at any time from Settings. Keep them secret: anyone holding a key can query the clone it belongs to. Requests are rate limited and count toward your plan’s usage limits. We may change or retire endpoints, and will give reasonable notice of breaking changes where we can. Do not use the API to scrape public clones or to build a competing dataset.

7. Organizations

An organization groups people at one company. The person who creates it becomes its first admin. Admins can invite and remove members, change their role, manage the organization’s plan and clone seats, and add company material. An organization must always keep at least one admin.

• Seats. Organization plans are billed on clone seats, meaning the members whose brain teammates can query, as shown on your order or in the organization’s billing screen.
• Teammate access. Members of the same organization can query each other’s clones even when those clones are not public. Questions asked of a clone inside an organization are logged, with secret-like text redacted, so the clone’s owner and the organization’s admins can see what the company is asking.
• Who owns what. Each member’s personal brain belongs to that member. Material an admin adds for the company belongs to the organization.
• Removal. When a member leaves or is removed, they lose access to teammates’ clones and company material, and teammates lose access to theirs. The member keeps their personal account and brain. When the last member leaves, the organization and its company material are deleted.

Business customers can sign our Data Processing Addendum, which covers personal data we process on an organization’s behalf.

8. Plans, payment and the free trial

Paid plans are monthly subscriptions, billed in advance through our payment processor, Razorpay. Prices and what each plan includes are on the pricing page. Customers in India are charged in Indian rupees; customers elsewhere are charged in US dollars, and their bank handles any conversion.

Free trial. The first subscription on an account starts with a 5-day free trial. You authorize the payment mandate at checkout and the first charge is taken when the trial ends. Each account gets one trial.

Auto-renewal. Your subscription renews automatically every month, and the payment method you authorized is charged at the start of each billing period until you cancel.

Taxes and invoices. Applicable taxes, including GST for customers in India, are shown at checkout. If you need a GST tax invoice that carries your business’s GSTIN, send your GSTIN and billing details to aashwin@makecortex.com.

Price changes. We will email you at least 30 days before a price change applies to your existing subscription. If you do not want the new price, cancel before it takes effect.

9. Cancellation and refunds

You can cancel at any time from Settings or by emailing aashwin@makecortex.com. No further charge is made after you cancel, and you keep access until the end of the period you already paid for. If you cancel during the free trial, you are not charged.

You can request a refund within 7 days of a charge. The full policy, with timeframes, is on our Refunds & cancellation page, which forms part of these terms. Cancelling does not delete your data; deleting your account does (see section 11).

10. Connected services

If you connect a third-party account, such as Google Calendar, you authorize Cortex to read the data that connection allows, only to provide the features you use. Data from connected accounts stays private to you by default: it can inform answers you ask for yourself, with attribution, but it is not used by your public clone or in answers to teammates. Your use of those services remains subject to their own terms.

11. Suspension, termination and deletion

We may suspend or close an account, or take a public clone offline, if you breach these terms, if your use creates a security or legal risk, or if payment fails and is not resolved. Where it is reasonable to do so, we will tell you first and give you a chance to fix the problem.

You can delete your account at any time from Settings. Your account locks immediately, and 7 days later your content is permanently destroyed, as described on our Trust page. You can export your data first.

12. Intellectual property

Cortex, its software, design and branding are owned by us or our licensors. These terms do not give you any right to them beyond using the service. If you send us feedback, we may use it without obligation to you.

13. Disclaimers

Cortex is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement, and we do not promise that the service or any answer will be accurate, uninterrupted or error-free.

14. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of Cortex. Our total liability for any claim relating to Cortex is limited to the amount you paid us in the 12 months before the event giving rise to the claim. Nothing in these terms limits liability that cannot be limited by law.

15. Governing law and disputes

These terms are governed by the laws of India. Before starting formal proceedings, please contact us and give us 30 days to try to resolve the dispute informally. Nothing here removes rights you have under the consumer law of the country where you live.

16. Changes to these terms

We may update these terms as Cortex changes. For material changes we will post the new version here with a new effective date and email account holders at least 30 days before it takes effect. Continuing to use Cortex after that means you accept the updated terms; if you do not, you can cancel and delete your account.
